1. Acceptance of Terms

By accessing and using the services provided by Heritage & Culture Tours Australia ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services

Heritage & Culture Tours Australia provides guided historical and cultural tours throughout Australia, including but not limited to:

• Group and private guided tours
• Educational programs and experiences
• Cultural heritage site visits
• Historical walking tours and transportation

3. Booking and Payment

3.1 Reservations

All tour bookings are subject to availability and confirmation. A booking is confirmed only when you receive written confirmation from us via email.

3.2 Payment Terms

• Full payment is required at the time of booking unless otherwise specified
• We accept major credit cards and bank transfers
• All prices are in Australian Dollars (AUD) and include GST where applicable
• Prices are subject to change without notice until booking is confirmed

3.3 Group Bookings

Special terms may apply for group bookings of 10 or more participants. Please contact us for group pricing and payment arrangements.

4. Cancellation and Refund Policy

4.1 Customer Cancellations

• Cancellations made 14+ days before tour date: 100% refund
• Cancellations made 7-13 days before tour date: 50% refund
• Cancellations made within 7 days of tour date: No refund
• No-shows: No refund

4.2 Company Cancellations

We reserve the right to cancel tours due to insufficient bookings, weather conditions, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule.

5. Tour Participation

5.1 Health and Safety

• Participants must be in reasonable physical condition for walking tours
• Please inform us of any medical conditions or mobility requirements
• Follow all safety instructions provided by tour guides
• We reserve the right to refuse participation to anyone deemed unfit for the tour

5.2 Age Requirements

Children under 16 must be accompanied by an adult. Some tours may have specific age restrictions which will be clearly stated in the tour description.

5.3 Conduct

Participants must conduct themselves respectfully towards guides, other participants, and cultural sites. Disruptive behavior may result in removal from the tour without refund.

6. Liability and Insurance

6.1 Limitation of Liability

To the maximum extent permitted by law, Heritage & Culture Tours Australia shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in our tours.

6.2 Personal Property

We are not responsible for loss, theft, or damage to personal property during tours. We recommend securing valuable items and obtaining appropriate travel insurance.

6.3 Travel Insurance

We strongly recommend that all participants obtain comprehensive travel insurance covering medical expenses, trip cancellation, and personal belongings.

7. Photography and Privacy

During tours, photographs and videos may be taken for promotional purposes. By participating in our tours, you consent to the use of your image in our marketing materials unless you specifically opt out.

8. Weather and Force Majeure

Tours operate in most weather conditions. In cases of extreme weather or force majeure events (natural disasters, strikes, etc.), we reserve the right to modify or cancel tours. Alternative arrangements or refunds will be offered where possible.

9. Intellectual Property

All content provided during tours, including historical information, stories, and educational materials, remains the intellectual property of Heritage & Culture Tours Australia.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
